The Story
Less than a week after HHS Secretary Kennedy proposed new rules limiting gender-affirming care for children and teens, Wisconsin joined 18 states and Washington D.C. in a lawsuit to protect access. The lawsuit argues that the Secretary does not have the authority to set medical standards, and that these rules could unfairly punish hospitals and providers that offer care.
Wisconsin Attorney General Josh Kaul emphasized that the state’s Medicaid program, which serves over a million people, is already legally required to cover gender-affirming care for minors because of a 2019 federal court ruling. The suing states are asking the court to rule the HHS declaration unlawful and block its enforcement.
